Know Your Towing Rights in Ontario: What Every Driver Should Understand

When it comes to towing, many drivers are unsure of their rights. At Ottawa Metro Towing, we believe in transparency, fairness, and helping our customers make informed decisions. Thanks to Ontario’s Towing and Storage Safety and Enforcement Act (TSSEA), effective January 1, 2024, you now have more protections than ever. Here’s what you need to know to ensure a safe and fair towing experience.

Your Rights Under Ontario’s Towing Regulations

1. You Choose Your Towing Company & Destination

You have the right to decide which towing company to use and where your vehicle is taken, unless law enforcement directs otherwise.

2. Consent Is Required Before Towing

A tow truck driver must obtain your written consent before towing your vehicle. Without your signature on a Consent to Tow form, the tow operator cannot charge you for services.

3. Transparent Pricing – No Hidden Fees

Before making any payment, you are entitled to receive an itemized invoice outlining all costs. Additionally, tow operators must accept multiple payment methods, including cash, credit, and debit. No more unexpected fees!

4. Access to Your Personal Belongings

If your vehicle is in a towing or storage facility, you have the right to retrieve personal belongings from it during business hours or at a pre-arranged time.

5. Tows Must Take the Most Direct Route

Tow operators are required to take your vehicle via the shortest route to your chosen destination. If your vehicle is taken elsewhere, you must be notified.

6. Tow Operators Must Disclose Any Referral Benefits

If a tow operator suggests a repair shop or other service, they must disclose if they receive compensation for the referral.

7. Certified and Licensed Tow Operators Only

Every tow truck operator and vehicle storage company must be certified under the TSSEA. Operators must display their name and certificate number on their tow truck. You have the right to request proof of certification.

How to Protect Yourself in a Towing Situation

Stay Informed – Understanding your rights helps you avoid unfair charges and delays.
Verify the Tow Operator – Always ask for identification and proof of certification.
Report Violations – If a tow operator fails to follow the law, you can file a complaint with the Ministry of Transportation.
